By accessing or using based.fit ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

Health and Fitness Disclaimer

• The Service does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any exercise program, especially if you have pre-existing health conditions.
• Heart rate data, workout statistics, and any other metrics provided are for informational purposes only and should not be used as a substitute for professional medical guidance.
• You are solely responsible for determining whether any exercise or fitness activity is appropriate for your physical condition. Listen to your body and stop exercising if you experience pain, dizziness, or discomfort.
• We make no guarantees about the accuracy of GPS tracking, heart rate measurements, calorie estimates, or any other fitness metrics. These are approximations based on available data.
• Any AI-generated workout suggestions or fitness advice should be reviewed critically and are not a replacement for professional training guidance.

User Responsibilities

As a user of based.fit, you agree to:

• Provide accurate information when creating your account and updating your profile
• Maintain the security of your account credentials and not share your password with others
• Accept full responsibility for all activities that occur under your account
• Use the Service only for lawful purposes and in accordance with these Terms
• Assess your own physical fitness level before engaging in any exercise tracked through the Service
• Notify us immediately of any unauthorized use of your account

Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of the Service
• Harass, abuse, or harm other users through the Service or connected platforms (e.g., Discord)
• Use the Service for any commercial purpose without our prior written consent
• Scrape, crawl, or use automated means to access the Service without permission
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity

Intellectual Property

The Service and its original content, features, and functionality are owned by based.fit and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any workout data, custom exercises, and routines you create. By using the Service, you grant us a non-exclusive license to store, process, and display this content solely for the purpose of providing the Service to you.

Account Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe:

• Violates these Terms of Service
• Is harmful to other users, us, or third parties
• Is fraudulent or illegal
• Abuses the Service or its resources

You may terminate your account at any time by deleting it through the app settings or by contacting us. Upon termination, your right to use the Service will immediately cease, and we may delete your data in accordance with our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by applicable law:

• based.fit and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service
• We are not liable for any injuries, health issues, or physical harm that may result from exercises or activities you perform while using the Service
• We are not responsible for any data loss, service interruptions, or technical issues that may affect your use of the Service
• Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. Your use of the Service is at your sole risk.

Third-Party Services

The Service may integrate with third-party services such as Discord, Polar heart rate monitors, and OAuth providers (Google, Apple, GitHub). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

Indemnification

You agree to indemnify, defend, and hold harmless based.fit, its operators, affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in New York, and you consent to the personal jurisdiction of such courts.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, through in-app notifications or email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
